General Terms and Conditions (GTC)<\/h1>\n

\u00a7 1 Scope<\/h2>\n

These General Terms and Conditions apply to all contracts concluded between qre8.studio (hereinafter referred to as the \u201cProvider\u201d) and the customer (hereinafter referred to as the \u201cClient\u201d) regarding the use of studio premises, the rental of equipment, and the use of production services.<\/p>\n

Any deviating terms and conditions of the Client shall not be recognized unless the Provider expressly agrees to their validity in writing.<\/p>\n

\u00a7 2 Conclusion of Contract<\/h2>\n
    \n
  1. Booking requests may be submitted by email, via the contact form on the website, or through agreed booking platforms.<\/li>\n
  2. A binding contract is concluded only upon written booking confirmation by the Provider.<\/li>\n
  3. Verbal side agreements require written confirmation in order to be valid.<\/li>\n<\/ol>\n

    \u00a7 3 Studio Use<\/h2>\n
      \n
    1. The studio premises may be used exclusively for the agreed purpose.<\/li>\n
    2. The Client is obliged to treat the premises with care and to leave them in proper condition.<\/li>\n
    3. Smoking and the consumption of alcohol or other intoxicating substances are not permitted in the studio premises unless expressly agreed otherwise.<\/li>\n
    4. The maximum number of persons per booking shall be determined on a case-by-case basis and may not be exceeded.<\/li>\n
    5. Animals are permitted only by prior written agreement.<\/li>\n
    6. Structural alterations, drilling into walls, or attaching objects to walls and ceilings are not permitted without express permission.<\/li>\n<\/ol>\n

      \u00a7 4 Equipment Rental<\/h2>\n
        \n
      1. The equipment provided (cameras, lenses, lighting, tripods, accessories, etc.) is handed over in functional and inspected condition.<\/li>\n
      2. The Client is obliged to handle the equipment properly and with care.<\/li>\n
      3. Subletting or transferring the equipment to third parties is not permitted.<\/li>\n
      4. Damage, loss, or theft of the equipment during the rental period shall be borne by the Client and must be compensated at the current replacement value.<\/li>\n
      5. Technical defects or irregularities must be reported to the Provider immediately.<\/li>\n
      6. The Client is liable for damage caused by improper use, even if such damage is unintentional.<\/li>\n<\/ol>\n

        \u00a7 5 Prices and Payment<\/h2>\n
          \n
        1. The prices valid at the time of booking according to the price list on the website or the individual offer shall apply.<\/li>\n
        2. All prices are stated in euros (EUR), unless otherwise indicated.<\/li>\n
        3. Payment shall be made, unless otherwise agreed:\n
            \n
          • for private individuals: in full in advance<\/li>\n
          • for companies: by invoice with a payment term of 14 days<\/li>\n<\/ul>\n<\/li>\n
          • For bookings over EUR 150, a deposit of 50% is due upon booking confirmation.<\/li>\n
          • In the event of late payment, the Provider is entitled to charge default interest at the statutory rate.<\/li>\n<\/ol>\n

            \u00a7 6 Security Deposit<\/h2>\n
              \n
            1. A refundable security deposit may be charged for the use of equipment and studio premises.<\/li>\n
            2. The amount of the security deposit shall be communicated during the booking process.<\/li>\n
            3. The security deposit will be refunded after the equipment has been returned and the premises have been inspected \u2014 usually within 5 working days \u2014 provided that no damage has been found.<\/li>\n
            4. If damage is found, the security deposit may be retained in whole or in part to cover the damage.<\/li>\n<\/ol>\n

              \u00a7 7 Cancellation and Rebooking<\/h2>\n
                \n
              1. Cancellations must be made in writing (by email).<\/li>\n
              2. The following cancellation conditions apply:
                \n\n\n\n\n\n\n\n\n
                Period before the appointment<\/th>\nCancellation fee<\/th>\n<\/tr>\n<\/thead>\n
                more than 7 days<\/td>\nfree of charge<\/td>\n<\/tr>\n
                3\u20137 days<\/td>\n30% of the booking value<\/td>\n<\/tr>\n
                less than 3 days<\/td>\n50% of the booking value<\/td>\n<\/tr>\n
                less than 24 hours<\/td>\n100% of the booking value<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<\/li>\n
              3. A free rebooking is possible once, provided that it is requested at least 72 hours before the scheduled appointment.<\/li>\n
              4. In cases of force majeure (e.g. natural disasters, official prohibitions), both parties shall be released from their performance obligations. Payments already made will be refunded in the form of a voucher.<\/li>\n<\/ol>\n

                \u00a7 8 Liability of the Provider<\/h2>\n
                  \n
                1. The Provider shall be liable without limitation in cases of intent and gross negligence as well as for injury to life, body, or health.<\/li>\n
                2. In cases of slight negligence, the Provider shall be liable only for the breach of essential contractual obligations (cardinal obligations), limited to the foreseeable damage typical for this type of contract.<\/li>\n
                3. Liability for consequential damages, loss of profit, or indirect damages is excluded to the extent permitted by law.<\/li>\n
                4. The Provider assumes no liability for damage to items or equipment brought in by the Client, unless such damage is attributable to gross negligence or intent on the part of the Provider.<\/li>\n<\/ol>\n

                  \u00a7 9 Copyright and Usage Rights<\/h2>\n
                    \n
                  1. All content created as part of the production (photos, videos, concepts) remains protected by copyright and belongs to the respective author.<\/li>\n
                  2. The Provider is entitled to use making-of recordings, behind-the-scenes content, and impressions from the studio for its own marketing purposes (social media, website, portfolio), unless the Client expressly objects.<\/li>\n
                  3. If the Provider is to create image or video material for the Client, the usage rights must be regulated separately in the contract.<\/li>\n<\/ol>\n

                    \u00a7 10 Data Protection<\/h2>\n

                    The collection and processing of personal data is carried out exclusively in accordance with the applicable data protection laws, in particular the GDPR. Further information can be found in our Privacy Policy on the website.<\/p>\n

                    \u00a7 11 Final Provisions<\/h2>\n
                      \n
                    1. The law of the Federal Republic of Germany shall apply.<\/li>\n
                    2. The place of performance and jurisdiction shall be Berlin, to the extent legally permissible.<\/li>\n
                    3. Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose.<\/li>\n
